Jakarta. The Corruption Eradication Commission (KPK) will investigate the alleged bribery made by the German multinational software company, SAP SE (SAP), to Indonesian officials. KPK will ask the Federal Bureau of Investigation (FBI) for more detailed documents regarding the case.

"In the SAP case, KPK has obtained documents that are still general in nature," said KPK Vice Chairman Alexander Marwata at the KPK building in Jakarta on Tuesday.

According to Alex, these documents include approvals for deferred prosecution agreements, orders from the Securities and Exchange Commission (SEC) related to SAP's investigation, and summaries of the case. 
 
"For more detailed documents related to the handling of cases in Indonesia, the FBI will correspond with us at the KPK. Of course, if these documents are used as evidence in court or investigation, we will follow up with the mutual legal assistance (MLA) mechanism," Alex explained.

Alex emphasized the need for coordination to leverage the various documents obtained by the FBI and SEC for further legal proceedings. He assured that the KPK would delve deeper into the allegations.

"We will certainly investigate the extent of the alleged bribery committed against Indonesian officials," said Alex.

SAP is set to pay fines exceeding $220 million (Rp3.44 trillion) to settle bribery allegations in the United States related to payments made to foreign government officials, as announced by the Justice Department on Jan. 10, 2024.

As per court documents referenced by the Justice Department, SAP, along with unidentified co-conspirators, engaged in providing bribes and other enticing incentives to foreign officials in South Africa and Indonesia. The company distributed gifts in various forms, including cash payments, political contributions, electronic transfers, and luxury goods acquired during shopping excursions.

In Indonesia, SAP is accused of providing bribes to individuals affiliated with the Ministry of Maritime Affairs and Fisheries (KKP) and the Telecommunications and Information Financing Provider Agency (BP3TI), now known as the Telecommunication and Information Accessibility Agency (Bakti) within the Ministry of Communication and Information.
