Court Ban on Dual Police Roles Could Reshape Top Posts from KPK to BNPT
Jakarta. A landmark Constitutional Court ruling that prohibits active police officers from holding positions outside the National Police could trigger major structural changes in several state institutions, including the powerful Corruption Eradication Commission (KPK) and the National Counterterrorism Agency (BNPT), both currently led by active police generals.
Coordinating Minister for Legal Affairs Yusril Ihza Mahendra said the government will fully comply with the ruling, calling the Constitutional Court “the final interpreter of the Constitution,” whose decisions cannot be appealed.
The government is now preparing legal adjustments and transition mechanisms to ensure compliance with the Constitutional Court’s decision.
Yusril noted that the decision will require amendments to Indonesia’s 2002 Police Law, which had long contained a legal gap enabling police generals to take up civilian posts without resigning from active duty.
“In practice, some officers have assumed civilian leadership roles because there was no explicit prohibition. With the Court’s decision, the law must now be revised,” he said.
He added that the ruling took effect immediately upon being read in an open court session.
Active Police Officers Currently Holding Civilian Leadership Roles
The ruling is expected to have direct implications for several high-ranking police officers who currently occupy civilian posts across government agencies:
1. Setyo Budiyanto — Chair, Corruption Eradication Commission (KPK)
2. Rudy Heriyanto Adi Nugroho — Secretary-General, Ministry of Marine Affairs and Fisheries
3. Panca Putra Simanjuntak — Senior official, National Resilience Institute (Lemhanas)
4. Nico Afinta — Secretary-General, Ministry of Law
5. Marthinus Hukom — Head, National Narcotics Agency (BNN)
6. Albertus Rachmad Wibowo — Head, National Cyber and Encryption Agency (BSSN)
7. Eddy Hartono — Head, National Counterterrorism Agency (BNPT)
8. Mohammad Iqbal — Inspector General, Regional Representatives Council (DPD RI)
Several of these institutions -- particularly KPK, BNPT, BNN, and BSSN -- play critical roles in governance, security, and public trust, meaning the ruling could lead to significant shifts in leadership and institutional dynamics.
