Mahalini and Rizky Febian's Wedding: What's the Law on Interfaith Marriage in Indonesia?
Jakarta. Mahalini and Rizky Febian are reportedly gearing up for their wedding in early May 2024, with ceremonies planned in both Bali and Jakarta.
The singers, known for their interfaith relationship, are undeterred by the challenges posed by their differing religious backgrounds. But what does Indonesian law say about interfaith marriages?
Interfaith Marriage Law
According to Article 2, paragraph (1) of Law Number 1 of 1974 concerning Marriage, "Marriage is valid if it is conducted according to the laws of each religion and belief."
This means that for an interfaith couple to legally marry, they must choose one religion to be recognized by law. Should one party choose not to convert, they must obtain a dispensation from the Minister of Religion.
The requirement for this dispensation ensures that the interfaith marriage respects the religious and belief systems of both parties and helps prevent potential conflicts arising from differences in faith.
Moreover, to be legally recognized, both parties must have the same religion stated on their identity cards (KTP). If this is not the case, they must convert to the same religion before marriage.
However, according to Circular Letter of the Supreme Court (SEMA) Number 2 of 2023, the court will not register interfaith marriages, citing that all religions prohibit such unions.
Thus, while not explicitly prohibited, interfaith marriages in Indonesia are subject to specific conditions, including obtaining permission from the Minister of Religion. These legal requirements present significant challenges for interfaith couples seeking marriage in Indonesia.
